The domestic work has its roots in the slavery past such as in Brazil or in the Middle Age, which explain the widespread discrimination by the country’s largest female category. With the exclusion of the constitutional rights, referring to several labor rights, the domestic workers class starts a struggle to intensify their equal rights. The treatment of inequality, granted by the Federal Constitution in its sole paragraph of Article 7, which exclude the domestic workers of several rights such as mandatory FGTS, unemployment insurance, fixing working hours, overtime and others, bring a consequence that prejudice the domestic workers and strengthen the differ treatment between the workers classes. However, Complementary Law no. 150, dated June 1, 2015, brought rights to previously uninsured employees, including work and vacation time, overtime, FGTS and fine for dismissal without just cause, contribution to INSS, accident insurance, simple domestic work.. For this, we used the logical analytic-synthetic and dogmatic-legal methods, through research in sites, doctrines, jurisprudentials, among others. The traditional method of research was the deductive-bibliographic and the helper was the historical.
