The monographic’s purpose is to determine if the vehicular protection granted by civil associations is an insurance outside the law, as well as if it has legal protection in the current Brazilian legal system. In addition, it was intended to analyze similarities and differences between this institute and the insurance contract. To do this, the following research methods were adopted: as regards the approach, it was classified as qualitative, as a level, as exploratory, and as to the procedure adopted, the research was bibliographical, in view of the studies that were carried out in doctrine on the insurance contracts, as well as documentary, because there have been reviewed judgments and bills related to the topic. With the study, it was possible to verify the absence of a legal seal regarding the existence of these civil associations of vehicle protection, but, on the other hand, it was also verified that there is no express legal permissive that legitimizes the performance of these associations of mutual assistance.
