Resumo: The purpose of the present work was to analyze the criminal protection granted in favor of animals in the existing legal system. For this, the study was developed, in terms of level, by the method of exploratory nature, in terms of approach, the qualitative one was adopted and in terms of the procedure used for data collection, the purely bibliographic method was used. The results of the present study were achieved through the analysis of criminal protection resulting from animal rights. In this perspective, it was found that there is no effectiveness of criminal protection in favor of animals, since illegal conduct is not effectively punished, with insufficient penalties and incapable of restraining and preventing the practice of the crime of animal abuse. Thus, it was possible to conclude that the standard is not effective, since the protection of animals is constituted with mere symbolism, which weakens the real function of protecting animals, causing the loss of the reliability of the normative law, without obtaining control. the practice of the crime of ill-treatment.

Para isso, o estudo se desenvolveu, quanto ao nível pelo método de natureza exploratória, quanto à abordagem foi adotada a qualitativa e quanto ao procedimento utilizado para a coleta de dados, foi empregado o método puramente bibliográfico. Os resultados do presente estudo foram alcançados através da análise da tutela penal decorrente dos direitos dos animais. Nessa perspectiva, constatou-se que não há eficácia da tutela penal em favor dos animais, visto que as condutas ilegais não são punidas com efetividade, sendo as penas insuficientes e incapazes de coibir e prevenir a prática do crime de maus-tratos a animais.
