Inverse affective abandonment: (in) legal security in the applicability of theory of disability in civil responsibility in Brasil

Resumo: The reverse affective abandonment and the violation of the duty of care by the children towards their parents is an increasingly recurring fact that has caused irreversible damage to the elderly, both physically and emotionally. In this context, the present research sought to carry out an analysis around the consequences that helplessness brings on family relationships, focusing on the reverse affective abandonment and the possibility of applying the theory of lack of love in a similar way to that situation considering that the elderly helpless by their descendants lack affection within the family. Based on these assumptions, panoramas of characterization and framing of legal requirements for civil liability will be drawn up through the legal instruments already existing in the Brazilian legal system to penalize those who submit their ancestors to the aforementioned situation, which is currently in need of specific civil legislation. Thus, it was intended, through the deductive method, not only to understand the conduct of those who use this harmful practice, but of the whole family about the importance of the duty of care, as a source of better quality of life for the elderly. In this context, it was possible to conclude that the penalties imposed as a form of civil liability against inverse affective abandonment, despite not reducing the physical and psychological pain caused to the elderly, need to be standardized specifically in order to provide legal certainty and avoid possible new cases of abandonment.

En este contexto, la presente investigación buscó llevar a cabo un análisis en torno a las consecuencias que la impotencia provoca en las relaciones familiares, enfocándose en el abandono afectivo inverso y la posibilidad de aplicar la teoría de la falta de amor de una manera similar a esa situación, considerando que los ancianos indefensos sus descendientes carecen de afecto dentro de la familia. Sobre la base de estos supuestos, se elaboraron panoramas de caracterización y enmarcación de los requisitos legales de responsabilidad civil a través de los instrumentos legales ya existentes en el sistema legal brasileño para penalizar a quienes someten a sus antepasados ​​a la situación mencionada que actualmente carece de una legislación civil específica. Por lo tanto, se pretendía, a través del método deductivo, no solo comprender la conducta de quienes utilizan esta práctica nociva, sino de toda la familia sobre la importancia del deber de cuidado, como fuente de una mejor calidad de vida para los ancianos. En este contexto, fue posible concluir que las sanciones impuestas como una forma de responsabilidad civil contra el abandono afectivo inverso, a pesar de no reducir el dolor físico y psicológico causado a los ancianos, deben estandarizarse específicamente para proporcionar seguridad jurídica y evitar posibles nuevos casos de abandonos.O abandono afetivo inverso e a violação do dever de cuidado por parte dos filhos para com os pais é um fato cada vez mais recorrente que tem gerado danos irreversíveis aos idosos tanto no âmbito físico, quanto emocional. Nesse contexto, a presente pesquisa buscou realizar uma análise em torno das consequências que o desamparo traz nas relações familiares, tendo como foco o abandono afetivo inverso e a possibilidade de aplicação da teoria do desamor de forma análoga à referida situação considerando que os idosos desamparados pelos seus descendentes carecem de afeto no seio familiar. A partir desses pressupostos foram traçados panoramas de caracterização e enquadramento de requisitos legais de responsabilidade civil por meio dos instrumentos jurídicos já existentes no ordenamento jurídico brasileiro para penalização daqueles que submetem seus ascendentes à referida situação que atualmente se faz carente de uma legislação civil específica. Pretendeu-se assim, por meio do método dedutivo, não somente entender a conduta daqueles que se utilizam desta prática nefasta, mas de toda a família sobre a importância do dever de cuidado, como fonte de melhor qualidade de vida do idoso.
