Resumo: This study aims at reflecting on the fundamental right to health and application through the Unified Health System. In the midst of this analysis, the judgment of the Extraordinary Appeal, with general repercussion of number 566.471 / RN, in the Which the rapporteur, Minister Marco Aurelio de Melo, voted in advance. The trial is suspended due to a request for hearing. Meanwhile, the position that will be adopted by the Federal Supreme Court will be paradigmatic and of observance by the courts, reason why the subject deserves special attention.

En medio de este análisis, está en juego el juicio del Recurso Extraordinario, con repercusión general, de número 566.471/RN, en el que el ponente, Ministro Marco Aurelio Melo adelantó su voto. El juicio está suspendido debido a un pedido de vista. Mientras tanto, la posición que adoptará el Supremo Tribunal Federal será paradigmática y de observancia por los tribunales, razón por la cual el tema merece especial atención.Objetiva-se com o presente estudo refletir sobre o direito fundamental à saúde e sua aplicação via Sistema Único de Saúde. Em meio à essa análise, está em pauta o julgamento do Recurso Extraordinário, com repercussão geral, de número 566.471/RN, no qual o relator, Ministro Marco Aurélio Melo adiantou seu voto. O julgamento está suspenso em razão de pedido de vista.
