Resumo: This review presents vote No. 46.057, of Civil Appeal No. 1.007.122-05.2017.8.26.0664 TJ/SP. The case addresses two different situations that merge into the same action, on the one hand an action of adverse possession and on the other the inventory of the same property. The TJ/SP took into account the fact that the heirs proved the right of direct possession of the property. The heirs were considered only the successors of the prospective purchasers. The 4th chamber of the TJ/SP accepted the appeal, giving the heirs the right to regulate the entire property, regardless of the regularization of the inventory.

El caso aborda dos situaciones distintas que confluyen en una misma acción, por un lado una acción de prescripción adquisitiva y por otro el inventario de un mismo inmueble. El TJ/SP tuvo en cuenta que los herederos acreditaban el derecho de posesión directa del inmueble. Los herederos se consideraban únicamente los sucesores de los posibles compradores. La 4ª Sala del TJ/SP acogió el recurso, dando a los herederos el derecho de regularizar la totalidad del inmueble, independientemente de la regularización del inventario.A presente resenha apresenta o voto n.º 46.057, da Apelação Cível n.º 1.007.122-05.2017.8.26.0664 TJ/SP. O caso aborda duas situações distintas que se fundem na mesma ação, de um lado uma ação de usucapião e do outro o inventário do mesmo imóvel. O TJ/SP levou em consideração o fato de que os herdeiros comprovaram o direito de posse direta do imóvel. Os herdeiros foram considerados apenas sucessores dos promitentes compradores.
