This study intends to analyse the concepts and legal foundations related to proof and burden of proof in labor proceedings; in this sense it intends to analyse the theory of the dynamic distribution of the burden of proof and the viability of its enforcement in labor proceedings. This study intends to analyse the enforcement of the mentioned theory considering the aptitude of the parties to bring proof in the proceeding, and analyse the benefits of the enforcement of such theory in labor proceedings, as well as possible damages to the parties’ material and procedural rights. In accordance to the conclusions gathered, this study intends to evaluate the legislation that rules such matter in Brazil, especially the Law 13.105/2015, that substitutes the actual Civil Procedure Law. In consideration of the individual labor proceeding, this study intends to analyse the foundations able to enforce the theory of the dynamic distribution of the proof to labor proceedings
