Resumo: The scope of the present study is to present trade dress and how it is intimately linked to the discipline of unfair competition. This evaluation should clarify the concept of trade dress, its requirements, its importance, where it fits into Industrial Property matter and how brazilian legal order and jurisprudence deals with the issue. Through the examination of recent cases and doctrine, this work intends to verify how the violation of trade dress is detrimental to the market and competition, and also to demonstrate how the repression of this violation happens in Brazil. Therefore, the study should know and analyze the current panorama of the unfair competition, mostly by the violation of trade tress, and what are the consequences to those who practice it. In this way, na information gathering will bem ade upon the theme to delimit how violation of trade dress occurs e how it is solved by the brazilian legal order

Esta avaliação deverá esclarecer o conceito de trade dress, seus requisitos, sua importância, onde ele se encaixa na matéria de Propriedade Industrial e como o ordenamento jurídico e a jurisprudência vêm tratando da questão. Por meio do exame de casos recentes e doutrinas, o trabalho tem a intenção de verificar como a violação ao trade dress é prejudicial ao mercado e à concorrência e também demonstrar como se dá a repressão a esta violação no Brasil. Portanto, o trabalho deve conhecer e analisar o panorama atual da concorrência desleal, notadamente a partir da violação ao trade dress e quais as consequências para aqueles que a praticam.
