The objective of this monograph is to analyse home insemination involving a third donor, conducted without the assistance of medical professionals specialising in assisted reproduction and without the requisite tests and techniques. In view of this, the objective was to illustrate the procedure and assess the implications of its practice. Given the absence of regulatory oversight, it is imperative to examine the intersection between the legislative gap and the potential consequences of this practice in the domains of health, medicine, bioethics, and the law. The law is a dynamic entity, and the evolution of legislation is a continuous process. Nevertheless, when a custom can have harmful effects on society, it is crucial to set limits by means of legislative control that can guarantee the rights of all those involved, including children born as a result of home insemination relationships, particularly those formed between homosexual couples.
