As a general rule, in the current systematic of the Brazilian Civil Procedure, lies with the Author the responsibility of proving the constitutive fact of its right and, with the Defendant, the impeditive, extinctive or amending acts of the Author’s right. However, due to the need of flexibilization of a norm that ends up mechanizing the process dynamics, a movement in the jurisprudence began, resulting in the implementation of the entitled “Dynamic Burden of Proof Theory”. Idealized by the Argentinian jurist Jorge W. Peyrano, in short, the burden of proof would lie upon the one in better conditions of demonstrating the events of the case, putting into perspective the mechanized burden of proof rule, as an innovation on the new civil procedure
