The present work critically analyzes the procedural conventions, in the current legal and social context, arising from the Code of Civil Procedure of 2015, on the burden of evidence, seeking to delineate the contours that led to the construction of a model of Civil Procedure in accordance with the requirements of the Constitutional State, to the use of a cooperative model, based on the principle of adequacy. For that, we have demonstrated the aspects of legal transactions to show the construction of the procedural conventions stipulated by art. 190 of the CPC, whether typical or atypical, as well as discuss the importance of evidence in Civil Procedural Law and especially the distribution of its burden in the Code of Civil Procedure and with this understand possible limitations and possibilities on the conventions about the burden of evidence
