Resumo: | This paper will discuss the constitutional and legal reasons used to reckon the obligation to apply, since the legislative amendment promoted in the article 373 of the Civil Procedure Code of 2015, the disposition regarding the burden of proof distribution as a disposition with double function (procedure and judgment). After a brief introduction, indicating the background of this paper and presenting the methodological and conceptual premises, the second chapter will generally investigate the static and dynamic theories regarding the distribution of the onus probandi, as well as a historical analysis of the burden of proof. The chapter will also expose the reasons why the legislative amendment in the article 373 of the Civil Procedure Code, prescribing the dynamic theory of the distribution of the burden of proof and if it represents an actual innovation. The third chapter will examine the preconditions to determinate if the dispositions regarding the distribution of the burden of proof are judgment dispositions or procedure dispositions, in reference to historical doctrine. The fourth chapter will elaborate, in reference to dominant procedure doctrine and the spirit unveiled by the new Civil Procedure Code, the concept of double function of the disposition regarding the distribution of the burden of proof, with implications to all procedures agents. All to answer, at the end, if the legislative amendment in the article 373 of the Civil Procedure Code allows, observing Legal Certainty, that the burden of proof is distributed in sentence or if it must be distributed previously, in interlocutory decision |

Após uma breve introdução, indicando o pano de fundo desta monografia e apresentando as premissas metodológicas e conceituais deste trabalho, o segundo capítulo investigará, de maneira geral, as teorias estática e dinâmica para distribuição do onus probandi, bem como breve histórico acerca do estudo sobre o ônus da prova. O capítulo também exporá as razões pelas quais a alteração legislativa na promulgação do CPC, art. 373, §1 ao prever a distribuição dinâmica do ônus da prova e se, realmente, implicou inovação no ordenamento processual. O terceiro capítulo examinará os requisitos para se determinar se as normas de distribuição do ônus da prova são de julgamento ou de procedimento com base na histórica doutrina. O quarto capítulo elaborará, tendo em vista a dominante doutrina processual e o espírito inaugurado pelo novel diploma processual, o conceito de dupla função da norma de distribuição do ônus da prova, com implicações para todos os agentes do processo.
