The general theory of the burden of proof is a fundamental concept in the legal system of several countries, including Brazil, and seeks to define who has the burden of presenting the necessary evidence to support the allegations made during the process. Initially, the burden of proof is assigned to the party making a claim or asserting a situation, but the burden of proof can be reversed when the party that would normally have the burden of proving a fact does not have access to the necessary evidence or cannot produce it. The main objective of this article is to address the application of the general theory of the burden of proof in legal disputes involving international air transportation of passengers, as well as to point out that the application of the dynamic theory of proof without due caution by judges sometimes leads to the filing of claims in small claims courts and civil courts due to an erroneous presumption that material or moral damages do not require proof or that such proof will be provided by the airline
