Resumo: This scholarly work is scoped to the analysis of the principle of fungibility in the guardianship of urgency as an instrument of power of judicial effectiveness, with proposed contribute to theoretical subsidies aimed at maximum simplification of its procedure to the detriment of the excessive formalism that culminates with the slowness of Justice, factor that generates its disrepute towards society nowadays. For this, it is necessary to approach the principle of fungibility and its impact on the tutelage of urgency as a result of the innovation introduced into procedural legislation by law 10,444/2002 which entered the §7 article 273 of the code of Civil procedure, with the clear intention to honor the speed in providing judicial review, providing citizens with the wide access to justice as fundamental guarantee provided for in the Federal Constitution. However, in the face of stagnant divergence about the theme that revolves around species and function of the guardianship of urgency, the exaggerated concern with analysis of its assumptions that ultimately misrepresent their true goal. The present paper seeks to lessen the importance of classifying emergency guardianship and emphasizes the main characteristic of this type of guardianship: the urgency, relativising the importance of other assumptions. All to enrich the debate with the main objective to achieve the effectiveness of judicial protection proposed by the legislature through the innovation brought by this Institute

All to enrich the debate with the main objective to achieve the effectiveness of judicial protection proposed by the legislature through the innovation brought by this InstituteO presente trabalho acadêmico tem como escopo a análise do princípio da fungibilidade nas tutelas de urgência como instrumento de alcance da efetividade jurisdicional, com proposta de contribuir com subsídios teóricos objetivando a máxima simplificação do seu procedimento em detrimento do formalismo exacerbado que culmina com a morosidade da Justiça, fator que gera o seu descrédito perante a sociedade nos dias atuais. Para isso, faz-se necessária a abordagem do princípio da fungibilidade e seu impacto na tutela de urgência em decorrência da inovação introduzida na legislação processual pela Lei 10.444/2002 que inseriu o parágrafo 7º ao artigo 273 do Código de Processo Civil, com a nítida intenção de prestigiar a celeridade na prestação jurisdicional, proporcionando aos cidadãos o amplo acesso à justiça como garantia fundamental estatuída na Constituição Federal. Contudo, diante da divergência estagnada acerca do tema que gira em torno das espécies e função das tutelas de urgência, observa-se a exagerada preocupação com a análise dos seus pressupostos que acaba por desvirtuar o seu verdadeiro objetivo. O presente trabalho busca amenizar a importância acerca da classificação das espécies de tutela de urgência e enfatiza a principal característica deste tipo de tutela: a urgência, relativizando a importância dos demais pressupostos.
