Resumo: | The present study intends to approach the recent changes in the Criminal Procedure Code ("CPP") brought by Law no. 13.964/2019, notoriously known as the "Anti-crime Package", which introduces the non-prosecution agreement in the Brazilian legal system. At first, this study analyzes consensualism in the differents legal systems, like common law and civil law, as well as the criminal negotiation mechanisms in the United States of America and Germany. Then, the Brazilian procedural system and the negotiated criminal justice in Brazil are analyzed, in addition to the consensual instruments that already exist, which are the civil composition of damages, the criminal transaction, the conditional suspension of the criminal procedure and the award-winning collaboration. In the third chapter, the non-prosecution agreement is detailed, being dissertated about its concept, legal nature and basis, requirements, prohibitive hypotheses, conditions to be adjusted, ministerial refusal for the proposal, the judge's role, the decision that ratify the agreement, the enfforcement, the effects of the non-accomplishment and of the full accomplishment of the agreed conditions, besides pertinent questions such as the discussion about the transaction being a subjective right of the investigated or a discretionary act of the prosecutor and the possibility of the agreement in criminal actions already started before the effectiveness of the article 28-A of the CPP. The scope of this study is to approach the main characteristics of consensual criminal law, highlighting the negative and positive points in using the mechanisms of negotiations in Brazilian criminal justiO presente trabalho tem a intenção de se debruçar sobre a recente alteração do Código de Processo Penal (“CPP”) promovida pela Lei n.º 13.964/2019, notoriamente conhecida como “Pacote Anticrime”, que introduziu o instituto do acordo de não persecução penal no ordenamento jurídico brasileiro. Em um primeiro momento, procura-se a analisar o consensualismo nos diferentes sistemas jurídicos de “common law” e “civil law”, além de mecanismos de negociação criminal nos Estados Unidos da América e na Alemanha. Passa-se, então, a análise do sistema processual brasileiro e da justiça penal negociada no Brasil, bem como dos instrumentos consensuais já existentes, quais sejam, a composição civil dos danos, a transação penal, a suspensão condicional do processo e a colaboração premiada. No terceiro capítulo, o acordo de não persecução penal é esmiuçado, sendo discorrido acerca de seu conceito, natureza jurídica, fundamento legal, requisitos, hipóteses vedatórias, condições a serem ajustadas, recusa ministerial para a propositura, o papel do juiz, a homologação, a execução, os efeitos do descumprimento e do integral cumprimento das condições convencionadas, além de questões pertinentes como a discussão sobre o referido negócio jurídico ser direito subjetivo do investigado ou ato discricionário do membro do parquet e a possibilidade do acordo em ações penais já iniciadas antes da vigência do art. 28-A do CPP.
