The purpose of the present study is to study the subject of preventive detention and the guarantee of public order and, in the sequence, describe how to basilar about the prison and its legal modalities such as: arrest in flagrante, temporary and preventive, under the aegis of rights and constitutional guarantees regarding the freedom of movement to come and go. Subsequently, to enter the focus of this study discussing the preventive custody mode and to carry out an analysis of the assumption that deals with the guarantee of public order as a basis for the use of the decree. Without pretension to exhaust the subject, the study will be based on the molds of the majority doctrine, as well as other indoctrinators that adopt diverse positions their use. Finally, consideration will be given to the analysis of this assumption of public order, under the aegis of the Federal Constitution, as well as in the doctrine and judgments contemporaneous with the Brazilian Court
