It this monograph, the study of the dynamical theory of burden of proof in the labor process, especially in reputable layoffs as discriminatory, where the issue permeates especially on the subjectivity of the judge and who has the evidential burden, which has fitness the possible nullities resulting from the inversion and changes after the effect of the new civil procedure code. The theme of the study developed in three chapters. The first chapter describes the most important historical data of the burden of proof in the labor process and the principles related evidence. The second chapter presents the legal nature and the dynamics of the burden of proof on procedural labor law In the third and fourth chapter addresses directly the subject under study. The essential historical overview for understanding the current state it is the Institute of proof, data and concepts of legal scholars, the difference between burden and obligation, and between subjective burden and objective and ultimately the burden of proof in the labor process in discriminatory dismissal
