Todavia, este não é um direito absoluto, o que implica a sua limitação quando esta se revela imprescindível para a realização, ou proteção, de outros direitos fundamentais. Dito isto, levanta-se uma questão: como é que se gere a coexistência do direito à greve com outros direitos atribuídos pela própria Constituição? A resposta passa pela aplicação da obrigação da prestação de serviços mínimos, prevista no artigo 57º/3 da CRP, cujo regime legal consta no artigo 537º do CT e seguintes, estando ainda sujeito ao disposto do artigo 18º da CRP, o princípio da proporcionalidade (no sentido amplo), por se enquadrar na categoria dos direitos, liberdades e garantias desde a revisão constitucional de 1982.Assim sendo, a presente dissertação de mestrado tem como objeto a análise da figura dos serviços mínimos, pretendendo-se explorar todo o seu regime legal e constitucional, de modo a esclarecer algumas problemáticas que se levantam aquando da sua utilização. O objetivo principal é estudar os aspetos mais importantes da greve e da obrigação de prestação de serviços mínimos, como meio de proteção de outros direitos constitucionalmente tutelados, de modo a esclarecer se estamos perante uma neutralização do direito de greve ou somente perante uma limitação do direito de greve (e de que modo se dá essa mesma restrição), e claro, de modo a compreendermos melhor esta figura jurídica. Serão muitas as questões a responder, quer estejam relacionadas com o fundamento da obrigação de prestar serviços mínimos, quer com os meios de determinação destes serviços, dando um especial relevo às consequências do não cumprimento da obrigação de prestar trabalho indispensável a assegurar a satisfação de necessidades sociais impreteríveis. Assim sendo, tentaremos explicar a importância dos serviços mínimos e perceber todos os pormenores importantes que os caracterizam, para tentarmos responder à derradeira questão: os serviços mínimos são um meio de neutralização do direito de greve (um direito incluído na categoria dos direitos, liberdades e garantias dos trabalhadores) ou são, de facto, uma limitação indispensável para a salvaguarda de outros direitos fundamentais, e se sim, qual a sua importância, função e quais são os efeitos do seu incumprimento?O direito à greve é, sem dúvida, um dos direitos fundamentais dos trabalhadores portugueses. Todavia, este não é um direito absoluto, o que implica a sua limitação quando esta se revela imprescindível para a realização, ou proteção, de outros direitos fundamentais. However, this is not an absolute right, which implies its limitation when it proves to be essential for the fulfillment, or protection, of other fundamental rights. Therefore, a question arises: how do you manage the coexistence of the right to strike with other rights attributed by the Constitution itself? The answer is to apply the obligation to provide minimal services, as laid down in the article 57º/3 of the CRP, the legal regime of which is set out in article 537º and following articles of the CT, and still subjected to the provisions of article 18º of the CRP, the principle of proportionality (in the widest sense), as it falls under the category of rights, freedoms and guarantees since the constitutional review of 1982.Thus, this master's dissertation intends to analyze the figure of minimal services, aiming to explore its entire legal and constitutional regime, in order to clarify some problems that arise when using it. There will be many questions to be answered, whether they are related to the basis of the obligation to provide minimal services, or related to the determination of these services, giving special emphasis to the consequences of non-compliance with the obligation to provide essential work to ensure the satisfaction of the imperative and essential social needs.
