REFLECTIONS ABOUT THE IDEOLOGICAL CONTROL OF TEACHING WORK AND THE FUNDAMENTAL RIGHT TO THE FREEDOM OF TEACHING

Resumo: The Federal Constitution brings in the article 205 and in the subsequent articles, the principles that must conduct the right to education, ensuring the freedom of teaching, learning, and the pluralism of ideas and pedagogical concepts. However, the right to freedom of teaching has not been universally accepted, which gave more visibility to movements such as Escola Sem Partido (School without Party). That movement argues that the students, while “captive audience of teachers”, would be victims of an alleged “ideological indoctrination”, in which “teachers that defend the leftist ideology” instill in the students some ideas that go against what is taught by the parents at home, which would be inadmissible, claiming that the teachers should only teach the contents of their subjects. In this context, it is indispensable to understand the motivations and the arguments that support the proposals of the Movement Escola Sem Partido, examining its pertinence and legitimacy. For this reason, this article seeks to ponder the possibilities of ideological control of teacher work, opposed to the freedom of teaching. To this end, we analyzed the main arguments of the studied Movement. In the same way, we sought to understand the legal nature of the right to freedom of teaching, based on authors who work on the theme with different focuses. In the end, we verified that education, while a social right, has as its main objective to create citizens, which is only possible when the teaching work is seen as a political act, able to make the teachers think about the place they occupy in society and in its possibilities of change.

Todavía, el derecho a la libertad de enseñar no ha sido aceptado de forma unánime, lo que dio mayor visibilidad a movimientos como la Escuela Sin Partido. Tal movimiento argumenta que los alumnos, encuanto audiencia cautiva de los profesores, serian victimas de una supuesta doctrinación ideológica, en que docentes defensores de ideologías de izquierda implanten en los discentes ideas contrarias a aquello que es enseñado por los padres en sus residencias, lo que sería algo inadmisible, alegando que cabería a los profesores, tanto solamente, ensenar el contenido de sus disciplinas. En ese contexto se hace imprescindible entender la motivación y los argumentos que sustentan las propuestas del movimiento Escuela Sin Partido, averiguando su pertinencia y legitimidad. Por ese motivo, el siguiente articulo busca reflexionar sobre las posibilidades de control ideológico del trabajo docente, en contraparte la libertad de enseñar. Por tanto, fueron analizados los principales argumentos del movimiento en estudio. De la misma forma, se buscó entender la naturaleza jurídica del derecho a la libertad de enseñar, basándose en autores que trabajan el tema en varios enfoques. Al final, se verificó que la educación, en cuanto derecho social, tiene por principal objetivo formar ciudadanos, o que solo es posible cuando el trabajador docente es visto como un acto político, capaz de llevar a los dicentes a reflexionar sobre el lugar que ocupan en la sociedad y en sus posibilidades de transformación.A Constituição Federal traz no artigo 205 e seguintes os princípios que devem reger o direito à educação, garantindo a liberdade de ensinar, aprender e o pluralismo de ideias e concepções pedagógicas. Todavia, o direito à liberdade de ensinar não tem sido aceito de forma unânime, o que deu maior visibilidade a movimentos como o Escola Sem Partido. Tal Movimento argumenta que os alunos, enquanto “audiência cativa dos professores”, seriam vítimas de uma suposta “doutrinação ideológica”, em que “docentes defensores da ideologia esquerdista” incutem nos discentes ideias contrárias àquilo que é ensinado pelos pais em suas residências, o que seria algo inadmissível, alegando que caberia aos professores, tão somente, ensinar o conteúdo de suas disciplinas. Nesse contexto, faz-se imprescindível entender a motivação e os argumentos que sustentam as propostas do Movimento Escola sem Partido, averiguando-se sua pertinência e legitimidade. Por esse motivo, o presente artigo busca refletir sobre as possibilidades de controle ideológico do trabalho docente, em contraponto à liberdade de ensinar. Para tanto, foram analisados os principais argumentos do Movimento em estudo. Da mesma forma, buscou-se entender a natureza jurídica do direito à liberdade de ensinar, baseando-se em autores que trabalham o tema nos mais variados enfoques.
