VIOLENCE, HUMAN RIGHTS AND RESTORATIVE PRACTICES IN SCHOOLS

Resumo: | The article problematizes the notions of violence and human rights and emphasizes restorative practices as a strategy for conflict resolution in the school space. Based on authors and concepts linked to the critical and relational theory of the themes in question and on field research, the article questions, in the case of violence, the legitimacy of institutional knowledge and practices which, in the expectation of conflict resolution, tend to separate and unilaterally oppose the figures of aggressor and victim. Regarding Human Rights, the persistence of academic-political knowledge is questioned, which gives more relevance and visibility to civil and political rights than to social rights, whose absence may impact different forms of violence among public high school students. Regarding restorative practices, the desired result of the research is to contribute to the inclusion of different forms of knowledge and local experiences in the processes of understanding and inducing non-violent public policies for conflict resolution on the school ground. |

A partir de autores y conceptos vinculados a la teoría crítica y relacional de los temas en cuestión y de la realización de investigaciones de campo, el artículo cuestiona, en el caso de la violencia, la legitimidad de saberes y prácticas institucionales que, en la expectativa de resolución de conflictos, tienden a separar y contraponer de forma unilateral las figuras de agresor y víctima, haciendo recaer sobre el primero un inventario de verdades y concepciones jurídico-morales, punitivas, culpabilizadoras y retributivas. En cuanto a los Derechos Humanos, se cuestiona la persistencia de un saber académico-político que otorga mayor relevancia y visibilidad a los derechos civiles y políticos que a los derechos sociales, cuya ausencia puede incidir en diferentes formas de violencia entre los estudiantes de las escuelas secundarias públicas. En cuanto a las prácticas restaurativas, el resultado deseado de la investigación es contribuir a la inclusión de diferentes formas de conocimiento y experiencias locales en los procesos de comprensión e inducción de políticas públicas no violentas para la resolución de conflictos en el espacio escolar.O artigo problematiza as noções de violência e Direitos Humanos e enfatiza as práticas restaurativas como estratégia resolução de conflitos no espaço escolar. Apoiando-se em autores e conceitos vinculados à teoria crítica e relacional dos temas em questão e à realização de pesquisa de campo, o artigo indaga, no caso da violência, a legitimidade de saberes e práticas institucionais que, na expectativa de resolução dos conflitos, tendem separar e contrapor de modo unilateral as figuras agressor e vítima, faz recair sobre primeiro um inventário de verdades e concepções jurídico-morais punitivas, culpabilizadoras e retributivas. Em relação aos Direitos Humanos, questiona-se a persistência de saberes acadêmico-políticos que conferem maior relevância e visibilidade aos direitos civis e políticos que aos direitos sociais cuja ausência pode impactar diferentes formas de violência entre os estudantes das escolas públicas do ensino médio.
