Com origem no histórico poder patriarcal e na discriminação contra a mulher, a violência de gênero atenta contra os direitos humanos inerentes à mulher. Inicialmente, o trabalho monográfico irá discorrer sobre a evolução histórica dos direitos da mulher, percorrendo eras distintas, desde a antiguidade até os dias atuais. No primeiro capítulo serão estudadas as várias formas de violência contra a mulher, tais como violência física, psicológica, sexual, patrimonial e moral. No segundo capítulo, serão analisadas algumas das possíveis causas sociais da violência contra a mulher, o papel de gênero e a violência doméstica. O terceiro capítulo abordará o problema do combate à violência doméstica contra a mulher, bem como as políticas públicas correspondentes. No quarto capítulo será estudada a Lei Maria da Penha e sua efetividade no combate à violência doméstica contra a mulher, abordando seu aspecto constitucional, a inaplicabilidade da lei dos juizados especiais, as alterações no Código Penal e a efetividade da lei nos juizados de violência doméstica e familiar contra a mulher – JVDFM. No último capítulo será revista a possível inconstitucionalidade da norma estudada.This study investigates the effectiveness of Law 11.340/06, which represented a reaction against the Brazilian state of gender violence that affects the country. Originating in the historic patriarchal power and discrimination against women, gender violence is undermining the rights inherent to women. Initially, the monograph will discuss the historical evolution of women's rights, covering different eras, from antiquity from to the present day. In the second chapter will study the various forms of violence against women, such as physical, psychological, sexual, and moral heritage. The third chapter will discuss some of the possible social causes of violence against women, the role of gender and domestic violence. The fourth chapter will address the issue of combating domestic violence against women, as well as the public policies involved.
