Para tanto, faz um resgate histórico da pena e da sua finalidade, sua utilização como pena propriamente dita e a realidade atual dos presídios. Focalizando a teoria do crime, pena e punição, buscando, a partir dessa teoria, definir a ressocialização e os meios mais eficientes para alcançá-la. Por conseguinte foram apresentados os direitos constitucionais dos presos, sua jornada de trabalho, a remição, os órgãos responsáveis pela execução penal, a Fundação de Amparo ao Trabalhador Preso, e o alcance do trabalho prisional. Por fim, procura tratar da importância do trabalho para a reabilitação do preso, a questão penitenciária como problema de todos e a responsabilidade social da empresa, que pode atuar na reintegração do egresso à sociedade. Ademais, são apontados dados obtidos na pesquisa de campo acerca do perfil e do trabalho do preso. Conclui que se as empresas utilizarem a mão-de-obra carcerária e lhes derem a devida capacitação, o trabalho pode ser um dos meios de reintegração do apenado e de evitar a reincidência. This paper consists of a brief study on the difficulties of the ex-convict from the Penitentiary System in reinserting himself/herself into the work market. For that, it makes a historical rescue of penalty and its goals, its use as punishment stricto sensu and the current reality of the penitentiaries. Focusing on the theory of crime, penalty and punishment, seeking to, starting from that theory, defining the resocialization and the most eficient means to reach it. As a result, the constitutional rights of the convicts have been presented, his/her work journey, remission, the responsible institutes for the criminal execution, the Fund for Assistance to the Working Convict, and the extent of imprisioned work. At last, it searches do deal with the importance of work for the reabilitation of the convict, the penitentiary matter as everyone´s problem and the social responsability of the enterprise, acting in the reintegration of the ex-convict into the society. Furthermore, it´s appointed data obtained in field search onthe work of the convict. It concludes that if the enterprises use the imprisoned workforce and give them proper capacitation, work may be one of the means of reintegration of the convict and avoiding the recurrence. As a result, the constitutional rights of the convicts have been presented, his/her work journey, remission, the responsible institutes for the criminal execution, the Fund for Assistance to the Working Convict, and the extent of imprisioned work. At last, it searches do deal with the importance of work for the reabilitation of the convict, the penitentiary matter as everyone´s problem and the social responsability of the enterprise, acting in the reintegration of the ex-convict into the society. Furthermore, it´s appointed data obtained in field search onthe work of the convict. It concludes that if the enterprises use the imprisoned workforce and give them proper capacitation, work may be one of the means of reintegration of the convict and avoiding the recurrence.
