Restrictions on access to labor justice in law 13.467/17: the judgment of ADI 5766/DF and the challenges that remain between the worker and access to justice

Resumo: Law 13.467/17 introduced restrictions to the human and fundamental right of access to the Labor Court in the CLT. Such restrictions conflict with the provisions of art. 5, XXXV and LXXIV of the Federal Constitution, hinder the effectiveness of constitutional and infra-constitutional labor rights and break the social guarantee of work. For these reasons, the STF judged, in October 2021, ADI 5766/DF, declaring the articles art. 790-B, caput and §4 and art. 791-A, §4 of the CLT Reformed. However, the declaration of unconstitutionality does not put an end to issues involving access to the Labor Court, leaving challenges between the worker and the labor judiciary. These challenges are represented by other restrictive provisions, which remain in force; by the numbers of the Labor Court, which point to a situation of contained litigation and the possibility of new restrictions. Qualitative and deductive research methods were used, through literature review and analysis of data released by the TST.

Tais restrições conflitam com as previsões do art. 5º, XXXV e LXXIV da CF, dificultam a efetividade dos direitos constitucionais e infraconstitucionais do trabalho e rompem com a garantia social do trabalho. Por essas razões, o STF julgou, em outubro de 2021, a ADI 5766/DF, declarando inconstitucionais os artigos art. 790-B, caput e §4º e art. 791-A, §4º da CLT Reformada. Todavia, a declaração de inconstitucionalidade emanada do STF não põe termo às questões envolvendo o acesso à Justiça do Trabalho, deixando ainda desafios entre o trabalhador e o Judiciário trabalhista. Esses desafios são representados pelos demais dispositivos restritivos, que permanecem vigentes; pelos números da Justiça do Trabalho, que apontam para uma situação de litigiosidade contida e pela possibilidade de novas restrições.
