Resumo: | Law 13.467/17 introduced restrictions to the human and fundamental right of access to the Labor Court in the CLT. Such restrictions conflict with the provisions of art. 5, XXXV and LXXIV of the Federal Constitution, hinder the effectiveness of constitutional and infra-constitutional labor rights and break the social guarantee of work. For these reasons, the STF judged, in October 2021, ADI 5766/DF, declaring the articles art. 790-B, caput and §4 and art. 791-A, §4 of the CLT Reformed. However, the declaration of unconstitutionality does not put an end to issues involving access to the Labor Court, leaving challenges between the worker and the labor judiciary. These challenges are represented by other restrictive provisions, which remain in force; by the numbers of the Labor Court, which point to a situation of contained litigation and the possibility of new restrictions. Qualitative and deductive research methods were used, through literature review and analysis of data released by the TST. |

Qualitative and deductive research methods were used, through literature review and analysis of data released by the TST.A Lei 13.467/17 introduziu na CLT restrições ao direito humano e fundamental de acesso à Justiça do Trabalho.
