The unsustainability of the general clause of boni mores: pluralism and laicity in contemporary society

Resumo: The paper problematizes the suitability of the generalclause of boni mores in view of the current conformation ofBrazilian legal order. In Roman-German matrix systems, the bonimores are traditionally used as a limitation to private autonomy.This guideline is reflected in several restrictive provisions of theCivil Code of 2002. In Brazil, however, the legal, doctrinal andjurisprudential treatment of the boni mores has been marked bythe absence of objective demarcations. In general, its applicationis based on social morality and is focused predominantly on thecontrol of sexual and family living. In this sense, the use of bonimores evinces a homogenizing and unjustified imposition ofthe model of good life defended by the majority groups. Thisreality contradicts the legal recognition of pluralism and laicityas important democratic vectors. In addition, it can be notedthat the ends sought by the boni mores could be satisfactorilyreached through other institutes with more solid dogmatic bases,such as the objective good faith and the public order. In thiscontext, through a theoretical investigation of juridical-dogmaticstrand and comprehensive-propositional type, it is concluded bythe unsustainability of the general clause of boni mores in thecontemporary society.

Nos sistemas de matriz romano-germânica, os bons costumes são tradicionalmente utilizados como limitação à autonomia privada. Trata-se de orientação refletida em diversos dispositivos restritivos do Código Civil de 2002. No Brasil, contudo, o tratamento legal, doutrinário e jurisprudencial dos bons costumes tem sido marcado pela ausência de demarcações objetivas. Em geral, observa-se uma aplicação fundamentada na moral social e voltada preponderantemente para o controle de vivências sexuais e familiares. Nesse sentido, o uso dos bons costumes evidencia uma imposição homogeneizante e injustificada do modelo de vida boa defendido pelos grupos majoritários. Essa realidade contraria o reconhecimento jurídico do pluralismo e da laicidade enquanto importantes vetores democráticos. Ademais, percebe-se que os fins almejados pelos bons costumes poderiam ser atingidos satisfatoriamente por meio de outros institutos com bases dogmáticas mais sólidas, como a boa-fé objetiva e a ordem pública.
