The Hart-Dworkin debate reread in the light of social criticism

Resumo: It explains six key points in the debate between Hart and Dworkin and connects the debate to two issues relevant to critical social theory. Discussion points are split in three circles. The outer circle concerns the existence of one (rules) or two (rules and principles) legal standards, as well as the existence and scope of a recognition rule. The middle circle touches on the themes of the meaning, breadth, and inevitability of judicial discretion and the relationship between law and morality. The inner circle, finally, involves the problem of theoretical disagreements and the differentiation between two types (descriptive and interpretive) of legal theory. The relevant problems for a critical social theory are, first, its relations with the stages of capitalism in general and liberalism in particular; and second, their respective positions concerning the achievements of the subaltern legal struggles of the 20th century.

Los problemas relevantes para una teoría social crítica son, primero, sus relaciones con las etapas del capitalismo en general y del liberalismo en particular; y, segundo, sus respectivas posiciones sobre los logros de las luchas jurídicas subalternas del siglo XX.Explica seis pontos fundamentais do debate entre Hart e Dworkin e relaciona este debate com dois problemas relevantes para uma teoria social crítica. Os pontos do debate são distribuídos em três círculos. O círculo externo diz respeito à existência de um (regras) ou de dois (regras e princípios) padrões jurídicos, bem como à existência e abrangência de uma regra de reconhecimento. O círculo intermediário toca nos temas do sentido, amplitude e inevitabilidade da discricionariedade judicial e da relação entre Direito e moral. O círculo interno, por fim, envolve o problema dos desacordos teóricos e da diferenciação entre dois tipos (descritivo e interpretativo) de teoria do Direito.
