Social State: a systematization to think about reconstruction

Resumo: The article presents the various aspects of the social state systematically. It organizes categories that can contribute to a more objective appreciation of the phenomenon, such as senses, characteristics, instruments, typologies, and chronology. The social state is a historical experience generated in times of war and deep crisis, whose mark is political, economic, and social concertation. Its legal framework presents significant local variations, ranging from more socializing conceptions of an interventional character on the economy to other conservative, protective of capitalists in times of crisis. Considered the “most remarkable achievement of engineering or political construction” (Bresser-Pereira), the construction of the welfare state has at least three marks: (1) was produced amid political struggles, was never given in advance; (2) positions in the disputes resulted from the ability to create consensus around certain driving ideas; (3) law played an important role in organizing the processes that transformed these ideas into institutionalized practices, as well as in modeling the practices themselves, values of social justice, democratic commitment, and fundamental rights. This combination was able to overcome the product of disastrous political choices. Considering the 2010s crisis, the reconstruction of the state demands collective action, with the renewal of its ability to act, overcoming the skepticism anti-State both from the right and the left. The methodology is based on bibliographical analysis and identifying relevant legal-institutional frameworks.

El Estado del bienestar es una experiencia histórica, generada en tiempos de guerra y de crisis profunda, cuya seña de identidad es la concertación política, económica y social. Su marco jurídico presenta importantes variaciones locales, que oscilan entre concepciones más socializadoras, de carácter intervencionista sobre la economía, y conservadoras, protectoras del capital en momentos de crisis. Considerada “la más notable ingeniería o construcción política” (Bresser-Pereira), la construcción del Estado social tiene por lo menos tres características: (1) se produjo en medio de luchas políticas, nunca dadas de antemano; (2) las posiciones victoriosas en las disputas resultaron de la capacidad de crear consenso en torno a ciertas ideas rectoras; (3) el derecho desempeñó un papel importante en la organización de los procesos que transformaron esas ideas en prácticas institucionalizadas, así como en la configuración de las propias prácticas, incorporando valores de justicia social, compromiso democrático y derechos fundamentales. Esto es lo que se abrió paso a través de la consternación resultante de las desastrosas decisiones políticas. Teniendo en cuenta las crisis de la década de 2010, la reconstrucción del Estado exige una acción colectiva, con la renovación de su capacidad de actuación, superando el escepticismo antiestatal de derecha e izquierda. La metodología se basa en el análisis bibliográfico y en la identificación de marcos jurídico-institucionales relevantes.O artigo faz uma apresentação sistemática dos vários aspectos do Estado social, organizando categorias, que possam contribuir para uma apreciação mais objetiva do fenômeno, tais como: sentidos, características, instrumentos, tipologias e cronologia. O Estado social é uma experiência histórica, gerada em momentos de guerra e crise profunda, cuja marca é a concertação política, econômica e social. Seu arcabouço jurídico apresenta variações locais significativas, que oscilam entre concepções mais socializantes, de caráter interventivo sobre a economia, a outras conservadoras, protetivas do capital em momentos de crise. Considerado a “mais notável realização de engenharia ou de construção política” (Bresser-Pereira), a edificação do Estado social tem pelo menos três marcas: (1) foi produzida no bojo de lutas políticas, nunca esteve dada de antemão; (2) posições vitoriosas nas disputas resultaram da capacidade de criar consenso em torno de certas ideias condutoras; (3) o direito teve um papel importante em organizar os processos que transformaram essas ideias em práticas institucionalizadas, assim como em modelar as práticas em si, incorporando nelas valores de justiça social, compromisso democrático e direitos fundamentais. Isso foi o que rompeu o desalento resultante de escolhas políticas desastrosas. Considerando as crises dos anos 2010, a reconstrução do Estado demanda ação coletiva, com a renovação de sua capacidade de agir, superando o ceticismo anti-Estado à direita e à esquerda.
