Resumo: The object of this essay concerns the atypical executive measures in the New Code of Civil procedure. The essay is structured in three points. The first of these refers to the grounds of the atypical measures in which it argues that, from the connection between the civil procedure and cultural phenomena, the typicality of the executive techniques is directly related to the civil procedure of Liberal State, as well as the atypical measures correlates closely with the civil procedure of the Constitutional State. Then, it analises normative structure of the atypical measures, in which it discuss some points concerning your legal system. Finally, it emphasizes the judicial application of the atypical measures which points out that the civil procedure of Constitutional State has the procedural mechanisms for the adoption of a binding measure atypical respects the integrity and independence of the legal system.

O trabalho estrutura-se em três pontos. O primeiro deles refere-se à fundamentação da atipicidade, em que se argumenta que, a partir da conexão entre o processo civil e os fenômenos culturais, a tipicidade das técnicas executivas encontra-se diretamente relacionada ao processo civil do Estado Liberal de Direito, assim como a atipicidade correlaciona-se intimamente com o processo civil do Estado Constitucional. Em seguida, destaca-se estrutura normativa da atipicidade, em que se discute como ela se projeta sobre o sistema de tutela jurisdicional executiva e qual o regime jurídico que assume.
