Resumo: The article aims to accomplish a state of the art related to scientific production in Brazil of doctoral thesis and master's dissertations, which are included in the database of the Coordination for the Improvement of Higher Education Personnel (CAPES), from 1988 to 2018, on the right to education and its interface with the financing of the area as well as analyzing the consequences of the discrepancy between the legal guarantee and its materialization. For that, 113 productions were analyzed. There was an increase in the number of papers and subjects dealt with, the need for more financial resources, the lack of studies on certain aspects, as well as the non-continuity of educational policies.

Para tanto, foram analisadas 113 produções.
