This article aims to analyze the conciliation with the Public Power in the scope of the Public Advocacy of the State of Rio Grande do Norte as a public agency that enforces human rights. In this regard, it is necessary to treat the concept of Access to Justice from the perspective of access to fundamental rights in a way that the process is fair, effective and timely. In fact, the New Civil Procedure Code (Law 13.105/15) seeks to provide the rite efficiency and the reasonable duration of the process by incorporating the consensual means of conflict resolution. Yet, this paper deals with the understanding of the conciliation not only as a way to reduce demands. But as a method capable of providing to jurisdiction the social pacification through the concrete solution of the controversy, with due given effectiveness in the procedure in which the Public Power appears as part of the proper solution to the conflict. In this context, an analysis was elaborated on the Public Advocacy of the State of Rio Grande do Norte as an essential state agency to Justice on the promotion of effectiveness to the fundamental rights. Thus, it is concluded that the Public Advocacy of the State of Rio Grande do Norte has some deficiencies in the promotion of fundamental rights as well as in the use of Conciliation as an instrument of effectiveness provided in the NCPC, affecting its performance as an essential public agency to Justice. Therefore, bibliographical research based on doctrine, legislation and public effectiveness reports was used.
