Direito.O presente trabalho possui como objetivo realizar uma reflexão aprofundada acerca da implementação da audiência de custódia no sistema processual penal pátrio, e a possibilidade da sua realização por meio da videoconferência, sob a perspectiva da magistratura brasileira. A audiência de custódia é compreendida como um direito fundamental, possuindo previsão legal no Pacto Internacional sobre Direitos Civis e Políticos e na Convenção Americana de Direitos Humanos, garantindo a toda pessoa presa o direito de ser conduzida, sem demora, à presença de uma autoridade judicial, buscando garantir a integridade física e mental do custodiado, a legalidade da prisão, bem como a mitigação da cultura do encarceramento. Em razão do surgimento da pandemia ocasionada pelo Covid-19, em novembro de 2020 o Conselho Nacional de Justiça pautou e autorizou a realização das audiências de custódia por videoconferência através da Resolução nº 357/2020, na 322ª sessão de julgamento do órgão deliberativo, obtendo apoio irrestrito dos representantes da magistratura brasileira. Assim, buscando entender a postura destas autoridades judiciais, no primeiro capítulo restou apresentado uma evolução histórica da audiência de custódia, no âmbito internacional e nacional, elucidando a relutância institucional na internalização deste instituto nas leis brasileiras. Após, buscando compreender o contemporâneo entendimento dos magistrados acerca da audiência de custódia, foi realizada uma análise das manifestações dos representantes da magistratura na 322ª sessão de julgamento do Conselho Nacional de Justiça, através da teoria fundamentada nos dados, sendo possível verificar-se, ao final, que a posição tomada pelos juízes acerca da audiência de custódia apoiando à sua realização através de videoconferência reflete a ideologia encarceradora e punitivista enraizada no sistema de justiça criminal brasileiro. A naturalização da violência policial pelos magistrados acarreta a banalização das proteções conferidas às pessoas presas, apresentando-se como um dos principais obstáculos à humanização do processo penal brasileiro.The present work aims to carry out an in-depth reflection on the implementation of the custody hearing in the Brazilian criminal procedural system, and the possibility of its realization through videoconferencing, from the perspective of the Brazilian judiciary. The custody hearing is understood as a fundamental right, legal provision in the International Covenant on Civil and Political Rights and the American Convention on Human Rights, ensuring that every person arrested has rthe right to be conducted without delay in the presence of a judicial authority, seeking to ensure the physical and mental integrity of the custody, the legality of the prison, as well as the mitigation of the culture of incarceration. Due to the emergence of the pandemic caused by Covid-19, in November 2020, the National Council of Justice held and authorized the holding of custody hearings by videoconference through the Resolution nº 357/2020, at the 322nd trial session of the deliberative body, obtaining unrestricted support from the representatives of the Brazilian judiciary. Thus, seeking to understand the posture of these judicial authorities, the first chapter presents a historical evolution of the custody hearing, at the international and national levels, elucidating the institutional reluctance to internalize this institute in Brazilian laws. Afterwards, seeking to understand the contemporary understanding of the magistrates about the custody hearing, an analysis of the manifestations of the representatives of the judiciary in the 322nd trial session of the National Council of Justice was carried out, through the theory based on the data, being possible to verify, at the final, that the position taken by the judges about the custody hearing supporting its realization through videoconference reflects the incarcerating and punitive ideology rooted in the Brazilian criminal justice system. The naturalization of police violence by magistrates leads to the trivialization of the protections given to prisoners, presenting itself as one of the main obstacles to the humanization of the Brazilian criminal process.80Florianópolis, SCAudiência de custódia.
