O motorista de aplicativo e a falácia do empreendedorismo

Resumo: A chamada uberização é um dos maiores e mais recentes expoentes da crescente agudização da precarização do trabalho. Tornada possível com a popularização dos smartphones e a expansão das Tecnologias da Informação e Comunicação, esta modalidade de trabalho precarizado encontrou terreno fértil na atual conjuntura de desmantelamento dos direitos trabalhistas e catástrofe pandêmica. Os motoristas de aplicativo são o maior exemplo dessa realidade - embora um grupo heterogêneo quanto à idade, escolaridade e raça, todos são igualmente expostos às imposições de um todo-poderoso aplicativo. O presente trabalho tem por objetivo analisar essa relação e a existência (ou não) de um vínculo empregatício entre a plataforma Uber e o imenso contingente de motoristas “parceiros” (mais de 1 milhão, conforme dados da Pesquisa Nacional por Amostra de Domicílios de 2019). Também tem o objetivo de elencar a atual postura do Governo Federal no primeiro ano da gestão do Presidente Luiz Inácio Lula da Silva com suas tentativas de regulamentação, e as recentes decisões judiciais acerca do tema.

Made possible by the omnipresence of smartphones in modern life and the expansion of Information and Communications Technology, this particular sample of precarious work found fertile ground in the present conjuncture of Brazil, aided by the dismantling of labor rights and its nefarious handling of the pandemic catastrophe of the early 20’s. Gig drivers are the biggest example of this harsh reality - although drivers differ greatly regarding age, education and race, all are equally oppressed by the designs of a all-powerful app. The present essay aims to analyze said relationship and the existence of an employment relationship between Uber and the humongous multitude of “partners” (more than 1 million, according to the Pesquisa Nacional por Amostra de Domicílios in 2019). description A chamada uberização é um dos maiores e mais recentes expoentes da crescente agudização da precarização do trabalho. Tornada possível com a popularização dos smartphones e a expansão das Tecnologias da Informação e Comunicação, esta modalidade de trabalho precarizado encontrou terreno fértil na atual conjuntura de desmantelamento dos direitos trabalhistas e catástrofe pandêmica. Os motoristas de aplicativo são o maior exemplo dessa realidade - embora um grupo heterogêneo quanto à idade, escolaridade e raça, todos são igualmente expostos às imposições de um todo-poderoso aplicativo. O presente trabalho tem por objetivo analisar essa relação e a existência (ou não) de um vínculo empregatício entre a plataforma Uber e o imenso contingente de motoristas “parceiros” (mais de 1 milhão, conforme dados da Pesquisa Nacional por Amostra de Domicílios de 2019). Também tem o objetivo de elencar a atual postura do Governo Federal no primeiro ano da gestão do Presidente Luiz Inácio Lula da Silva com suas tentativas de regulamentação, e as recentes decisões judiciais acerca do tema.
