Resumo: ABSTRACT. The theme of this article dealt with the Early Childhood Education in Rural Area. The objectives were: to assess the implementation of legislation that guides the Childhood Education in Rural Area and discuss the care of children in the Municipal Rural School Mario Bettega, confronting the legislation with its application. This was a bibliographic and documentary research about the legislation that guides the Early Childhood Education, watching it in the school routine. Initially was presented a historical overview of the Brazilian Early Childhood Education, of the childhood conceptions and of the Education in Rural Area, reflecting, this way, on the data obtained in this research. It was detected that there are contradictions between the progress of the legislation - to ensure the right to Childhood Education in Rural Area - and its implementation in the school, that was assisted, because the Department of Education and Culture of Chopinzinho does not work with any document for the Early Childhood Education in Rural Areas and it does not offer a specific training for the professionals in this area. The school, that was assisted, disregards the education and the school in rural area concept, either in its internal documents (such as 2007 PPP), or on the teaching organization. These contradictions express the limits of the bourgeois State, which incorporates the demands of the society in formal terms and do not abide them in the real plane.

Los objetivos fueron: analizar la aplicación de la legislación que guía la Educación Infantil del Campo y problematizar el cuidado de los niños en la Escuela Municipal Rural Mário Bettega, enfrentando la legislación y su aplicación. Fue investigación bibliográficos y documental de la legislación que guía la primera infancia del campo, observándola la rutina de la escuela. Inicialmente fue presentada visión histórica de la educación de la primera infancia brasilera, las concepciones de infancia y de la Educación del Campo, reflejando los datos en la investigación. Se detectó contradicciones en los avanzos de legislación – para garantizar el derecho a la Educación Infantil en el campo – y su efectividad en la escuela investigada, debido que el Departamento de Educación e Cultura de Chopinzinho no trabaja con cualquier documento de la Educación Infantil del Campo ni ofrece formación específica para los profesionales en esta área.  La escuela investigada desatiende la concepción de educación e escuela del campo, en sus documentos interna (como el PPP de 2007), y en la organización de la enseñanza.  Las contradicciones demuestran los límites del Estado burgués, que incorpora las reivindicaciones de la sociedad en su plan formal y no las cumple en su plan real.ABSTRACT. Os objetivos foram: analisar a implementação da legislação que orienta a Educação Infantil do Campo e problematizar o atendimento às crianças na Escola Rural Municipal Mário Bettega, confrontando a legislação com sua aplicação. Tratou-se de pesquisa bibliográfica e documental acerca da legislação que orienta a Educação Infantil, observando-a no cotidiano da escola. Inicialmente foi apresentado um panorama histórico da Educação Infantil brasileira, das concepções de infância e de Educação do Campo, assim refletindo sobre os dados obtidos na pesquisa. Detectou-se que existem contradições entre os avanços da legislação – que assegurem o direito à Educação Infantil no campo – e sua efetivação na escola pesquisada, pois a Secretaria de Educação e Cultura de Chopinzinho não trabalha com nenhum documento para a Educação Infantil do Campo e não oferece formação específica aos profissionais desta área. A escola pesquisada desconsidera a concepção de educação e escola do campo, seja nos seus documentos internos (como o PPP de 2007), seja na organização do ensino. Tais contradições expressam os limites do Estado burguês, que incorpora as reivindicações da sociedade no plano formal e não as cumpre no plano real.
