Aborda as garantias constitucionais inerentes ao tema, especialmente o direito à vida, o direito à liberdade e o princípio da dignidade da pessoa humana. Estuda as comparações e o conflito existente entre os preceitos garantidos pela nossa Constituição Federal, tais como o direito à saúde, dignidade da pessoa humana e direito à liberdade.  Analisa os tipos de internações psiquiátricas e o seu amparo legal.
