A princípio, teria o intuito fundamental de facilitar e ampliar o acesso à justiça, assumindo especial relevância perante litigantes economicamente hipossuficientes. No entanto, sobrevém uma situação de desequilíbrio, na qual o indivíduo desamparado e sem conhecimento técnico enfrenta disputantes assistidos por profissionais qualificados. Tal disparidade é notória sobretudo em se tratando de litígios trabalhistas, que costumeiramente envolvem partes com ampla disparidade socioeconômica. Questiona-se, assim, se o jus postulandi tem realmente capacidade de viabilizar efetivo acesso à justiça. Originally, jus postulandi intended to fundamentally facilitate and broaden access to justice, becoming particularly relevant for litigants under financial distress. However, one can now observe an imbalance whereas a vulnerable litigant with no technical knowledge faces defendants backed by qualified legal teams. Such disparity is notorious mostly amongst labor litigation cases, which often involve parties with an implicit socioeconomic disparity. Therefore, it becomes questionable whether jus postulandi is indeed effective in enabling wider access to justice.
