This paper addressed the issue of the right to the protection of linguistic culture in basic education in indigenous communities. The general objective is to investigate how the protection of indigenous languages ​​occurs and its approach in indigenous basic education schools in Brazil. The specific goals are to address the context of annihilation of indigenous peoples and the removal of their culture in contemporary Brazil, to study the legal protection of indigenous culture in Brazil guaranteed in the Federal Constitution of 1988, and finally, to verify the guidelines of basic education for indigenous communities related to the maintenance of native languages. Thus, the question is: does the State fulfill its constitutional obligation of indigenous language in indigenous schools for the maintenance of this culture? As a hypothesis, there is the conception that indigenous people represent an inferior culture, which was created from a Eurocentric view of the Portuguese and historically reproduced in Brazil. The right to preserve indigenous culture was guaranteed only from the 1988 Constitution and this protection is still insufficient. The results achieved indicate that there is a lack of regularization in education systems, infrastructure, and also in official censuses on schools that maintain bilingual education. The approach method is deductive and the method of monographic procedure, with bibliographic and documental research techniques.
