Labor reforms, flexibility and new forms of hiring: impacts on the labor market in Brazil from 2012 to 2019

Resumo: Brazil, in the post-crisis period of 2015/2016, has “advanced” towards greater flexibility in relations and labor regulation. This trajectory has caused significant changes in the world of work, especially regarding its organization and dynamics. This article seeks to present some reflections on the impacts of the Labor Reform of 2017, of the edition of MP no 881 that institutes the Declaration of Rights of Economic Freedom and MP no 905 (Yellow Green Labor Contract) on the future of the labor market in Brazil. To this end, the data available at CAGED and PNAD Continuous will be explored. The data have pointed out that the implemented Labor Reform was not able to provide a recovery of the labor market, despite the discourse of modernization of the CLT, which presented it as an indispensable condition for the country to generate jobs again. The new round of easing of labor legislation went in the same direction, that is, the non-recovery of the labor market. In conclusion, it is argued that the solution to the problems of employment and income is to increase economic activity associated with regulatory mechanisms that protect and do not remove workers' rights.

Esta trayectoria ha provocado cambios significativos en el mundo del trabajo, especialmente en su organización y dinámica. Este artículo busca presentar algunas reflexiones sobre los impactos de la Reforma Laboral de 2017, de la edición de la MP no 881 que instituye la Declaración de Derechos de Libertad Económica y la MP no 905 (Contrato Laboral Verde Amarillo) sobre el futuro del mercado laboral en Brasil. Para ello, se explorarán los datos disponibles en CAGED y PNAD Continuous. Los datos han señalado que la Reforma Laboral implementada no logró brindar una recuperación del mercado laboral, a pesar del discurso de modernización del CLT, que lo presentó como una condición indispensable para que el país vuelva a generar empleos. La nueva ronda de flexibilización de la legislación laboral fue en la misma dirección, es decir, la no recuperación del mercado laboral. En conclusión, se argumenta que la solución a los problemas de empleo e ingresos es incrementar la actividad económica asociada a mecanismos regulatorios que protegen y no eliminan los derechos de los trabajadores.Le Brésil, dans la période post-crise de 2015/2016, a «progressé» vers une plus grande flexibilité dans les relations et la réglementation du travail. Cette trajectoire a provoqué des changements significatifs dans le monde du travail, notamment en ce qui concerne son organisation et sa dynamique. Cet article vise à présenter quelques réflexions sur les impacts de la réforme du travail de 2017, de l'édition du MP n ° 881 qui institue la Déclaration des droits de liberté économique et du MP n ° 905 (Contrat de travail jaune vert) sur l'avenir du marché du travail au Brésil. À cette fin, les données disponibles au CAGED et au PNAD Continuous seront explorées. Les données ont souligné que la réforme du travail mise en œuvre n'a pas été en mesure d'assurer une reprise du marché du travail, malgré le discours de modernisation de la CLT, qui la présentait comme une condition indispensable pour que le pays génère à nouveau des emplois. Le nouveau cycle d'assouplissement de la législation du travail est allé dans le même sens, à savoir la non-reprise du marché du travail. En conclusion, il est avancé que la solution aux problèmes de l'emploi et des revenus consiste à accroître l'activité économique associée à des mécanismes réglementaires qui protègent et ne suppriment pas les droits des travailleurs.O Brasil, no período pós Crise de 2015/2016, tem “avançado” em direção a uma maior flexibilização das relações e da regulação do trabalho. Essa trajetória tem provocado mudanças significativas sobre o mundo do trabalho, especialmente quanto à sua organização e sua dinâmica. O presente Artigo procura apresentar algumas reflexões sobre os impactos da Reforma Trabalhista de 2017, da edição da MP no 881 que institui a Declaração de Direitos de Liberdade Econômica e da MP no 905 (Contrato de Trabalho Verde Amarelo) sobre o futuro do mercado de trabalho no Brasil. Para tanto, serão explorados os dados disponíveis no CAGED e na PNAD Contínua. Os dados têm apontado que a Reforma Trabalhista implementada não se mostrou capaz de proporcionar uma recuperação do mercado de trabalho, a despeito do discurso de modernização da CLT, que a apresentava como condição indispensável para que o país voltasse a gerar empregos. A nova rodada de flexibilização da legislação trabalhista caminhou na mesma direção, isto é, da não recuperação do mercado de trabalho.
