The Civil Liability of the Disabilities and Parents by Damaged Acts Practiced by their Children Minor and Major Age

Resumo: The present article, of bibliographic character and deductive method, analyzed the civil liability of the parents for damaged acts practiced by their sons and daughters minor or major ages. It started with the study of the parents’ civil responsibility for the acts of the minor children, based on the theory of risk. For the civil law, parents are liable for damaged acts of minor children and will have no right of recourse against the child, including making no distinction as to whether the child’s disability is absolute or relative. In general, parents will not respond civilly for the conduct practiced by their older children, with the exceptions demonstrated and questioned throughout the article.

Empezó con el estudio de la responsabilidad civil de los padres por los actos de los hijos menores, basada en la teoría del riesgo. A la luz del derecho civil, los padres contestan, frente a terceros, por los actos de sus hijos menores y no tendrán derecho de regreso contra el descendiente, incluso no se hace distinción si la incapacidad del hijo es absoluta o relativa. En general, los padres no contestarán civilmente por las conductas practicadas por hijos mayores, con las excepciones presentadas y cuestionadas a lo largo del trabajo. O presente artigo, de caráter bibliográfico e método dedutivo, analisou a responsabilidade civil dos genitores por atos danosos praticados pelos seus filhos maiores e menores de idade. Iniciou com o estudo da responsabilidade civil dos pais pelos atos dos filhos menores, fundada na teoria do risco. À luz do direito civil, os pais respondem, perante terceiros, pelos atos dos filhos menores e não terão direito de regresso contra o descendente, inclusive não se fazendo distinção se a incapacidade do filho é absoluta ou relativa. Em geral, os pais não responderão civilmente pelas condutas praticadas pelos filhos maiores, com as exceções demonstradas e questionadas ao longo do trabalho.
