Resumo: This work aims at assessing the extra judicial procedure in the Law nº. 11.441/2007, which deals with the realization of consensual separation and divorce by the use of an administrative way, as well as to explain the controversies that emerged due to the Law’s omission. We also attempt to demonstrate that, provided it is used correctly, this Law will provide the citizen access to this deserving right speedily and effectively.

Pretende todavía demostrar que, si ésta ser correctamente utilizada, proporcionará el acceso del ciudadano al derecho que le compite de forma rápida y eficaz.O presente trabalho se destina a avaliar o procedimento extrajudicial da Lei nº. 11.441/2007, que trata da realização da separação e do divórcio consensual pela via administrativa, bem como dirimir as controvérsias que surgiram da omissão da lei.
