Resumo: The institutes of consensual justice in the scope of criminal law represent important instruments of criminal policy aimed at reducing judicial demands and resolving conflicts of small and medium offensive potential. The criminal non-prosecution agreement, introduced in the Brazilian legal system from Resolution 181/2017 of the National Council of the Public Ministry, and later modified by Law 13.964/2019, has stood out in relation to crimes of medium offensive potential. This article aims to interpret the legal nature of the criminal non-prosecution agreement, due to the existing controversy, that is, it is a power-duty of the Public Ministry or a subjective right of the defendant. Therefore, the deductive method was used, starting from the theoretical and jurisprudential discussion about the matter to achieve the desired results.

O Acordo de Não Persecução Penal (ANPP), introduzido no ordenamento jurídico brasileiro a partir da Resolução 181/2017 do Conselho Nacional do Ministério Público, e posteriormente modificado pela Lei 13.964/2019, tem se destacado no tocante aos crimes de médio potencial ofensivo. O presente artigo visa interpretar a natureza jurídica do ANPP, em razão da controvérsia existente, isto é, trata-se de um poder-dever do Ministério Público ou de um direito subjetivo do investigado.
