A escolha desse assunto se deu ante o cenário da superlotação carcerária no território nacional, tendo em vista o poder que tais audiências têm em reduzir o número de presos provisórios. Inicialmente, abordamos o conceito de audiência de custódia e seus fundamentos jurídicos na Constituição Federal, na Convenção Americana de Direitos Humanos e no Pacto Internacional dos Direitos Civis e Políticos. Após, passou-se a debater sobre a Resolução 213/15 do Conselho Nacional de Justiça. Nesse passo, foi exposta a origem e justificativa para o advento da Resolução, suas características, o conceito e efeitos, bem como a análise da referida Resolução. Posteriormente, abordou-se a implementação das audiências de custódia na cidade de São Paulo, falando sobre o Projeto Audiência de Custódia e o pioneirismo paulistano na implementação das audiências, sobre o início das audiências de custódia na capital paulista, além de apresentar as primeiras dificuldades encontradas, o perfil dos presos em flagrante e quais os principais crimes apontados em audiência. Por fim, trouxemos os resultados e efetividade nos primeiros 2 anos e na atualidade.The objective of this study is to deepen the studies on the subject of custody hearing, with emphasis on its importance as a guarantee of the effectiveness of the fundamental rights of the inmate in flagrante delicto. The choice of this subject occurred in the scenario of prison overcrowding in the national territory, given the power that such hearings have in reducing the number of provisional prisoners. Initially, we discussed the concept of custody hearing and its legal basis in the Federal Constitution, the American Convention on Human Rights, and the International Covenant on Civil and Political Rights. After that, it was discussed the Resolution 213/15 of the National Council of Justice. In this step, the origin and justification for the advent of the Resolution, its characteristics, the concept and effects, as well as the analysis of what Resolution said were exposed. Subsequently, the implementation of the custody hearings in the city of São Paulo was discussed, talking about the Project Audiência de Custódia and the pioneering São Paulo in the implementation of the hearings, about the beginning of the custody hearings in the city of São Paulo, besides presenting the first difficulties found in the hearings, the profile of the prisoners in flagrante and what the main crimes pointed out in hearing.
