An analysis of the theme of animal mistreatment was carried out. It was investigated whether the punishment for the crime of mistreatment of animals is sufficient to change the social reality. The general objective was to provide a historical and legal context for mistreatment in Brazil. The methodology used was the literature review and the research is characterized as exploratory. For the analysis of the question, the relationship between human beings and animals (still and constantly evolving in law) and an overview of animal protection in Brazil will be explored. It was found that animal suffering should not be ignored by society, mainly by the operators of the law, as the rights of animals are legally protected (in constitutional terms and in infra-constitutional legislation), and must be guaranteed. It concluded that there was a need to improve legislation, so that punishments become more rigid and appropriate to the seriousness of the crime of mistreatment.
