Reportamo-nos, mais concretamente, aos casos em que, por insuficiência de conhecimentos e meios técnicos ou profissionais adequados, uma das partes acaba por não conseguir produzir prova dos factos por si alegados, vendo a causa decidida em favor da parte que, tendo conhecimento de tal debilidade, e apesar de usufruir de tais meios, se mantém inerte.Perante a obrigação ineludível de resolver pacífica e coativamente o conflito de interesses, concede-se ao juiz a ferramenta que lhe permita solucioná-lo: as regras de distribuição ou repartição do ónus da prova. Porém, ao lado da regra estática observada no sistema jurídico português, vemos surgir em diversos outros ordenamentos uma regra dinâmica que atribui ao julgador a possibilidade de, perante as circunstâncias do caso – nomeadamente a manifesta desigualdade das partes em termos de produção de prova – operar uma redistribuição do ónus probatório, enfatizando valores como a igualdade material das partes, o acesso efetivo à justiça ou a justiça do caso e promovendo a cooperação das partes.Propomo-nos, neste sentido, levar a cabo um ensaio crítico sobre as eventuais vantagens da adoção no ordenamento jurídico português da tão aclamada teoria da distribuição dinâmica do ónus da prova, apontada noutros ordenamentos como solução cabal para o problema.Ante uma regra estática, assente na natureza dos factos invocados e respetivos efeitos para as partes e indiferente à eventual dificuldade probatória, surge a questão de saber se poderá a teoria ter ou não acolhimento no seio de um ordenamento jurídico pautado pela cooperação na descoberta da verdade com fim à justa composição do litígio.The following study seeks to analyze the current static rule of distribution of the burden of proof in light of the evidential difficulties that sometimes arise for one of the parties.
