ANALYTICAL TENDENCIES OF THE COMPULSORY PRESCHOOL: 10 YEARS OF THE APPROVAL OF LAW EC 59/09

Resumo: This article aims at producing an interpretation of analysis from researches published in journals, thesis, and dissertations concerning the topic of compulsory preschool between 2010 and 2020. It is a theoretical study which, through the systematic study of this production, attempted to find quantitative recurrences. Thus, the interpretation allowed to outline three analytical tendencies in a qualitative way. The first one refers to the discussion that compulsory preschool was established amid other laws that established nine years of elementary school and, consequently, the reduction of the time dedicated to preschool and to the questions concerning the children’s right to live childhood. The second one is related to the agenda of multilateral organisms which, through the status granted to certain scientific evidence, above all those from neuroscience, attempt to link the frequency at preschool to good results in elementary school.  The third one presents the main strategies cities have given up in order to universalize preschool. Among them, the increase of partnerships, the creation of preschool classes in elementary schools, the offer of part-time schools and the privatization of education.

Es una investigación teórica que buscó, por medio de un estudio sistemático de esta producción, ir más allá de encontrar incidencias cuantitativas, permitiendo delinear tres tendencias analíticas de forma cualitativa. La primera se refiere a la discusión de que la obligatoriedad de la preescuela surgió en leyes que sostienen la enseñanza primaria de nueve años y la reducción del periodo dedicado a la educación infantil y a las cuestiones que involucran el derecho de los niños a vivir la infancia. La segunda se relaciona a las agendas de organismos multilaterales que buscan, por intermedio del estado conferido a determinadas evidencias científicas, principalmente a aquellas que provienen de las neurociencias, asociar la frecuencia en la preescuela a un buen resultado en la enseñanza primaria. La tercera presenta las estrategias utilizadas por las ciudades para alcanzar la universalización de la preescuela, como el incremento de convenios, la inserción de grupos de preescuela en escuelas de enseñanza primaria, la oferta en turno parcial y la privatización de la educación.Este artigo tem por objetivo produzir uma interpretação das análises oriundas de pesquisas publicadas em periódicos, teses e dissertações acerca da temática da obrigatoriedade da pré-escola, no período compreendido entre 2010 a 2020. Trata-se de um estudo teórico que buscou por intermédio do estudo sistemático dessa produção ir além de encontrar recorrências quantitativas, sendo assim, a interpretação permitiu delinear três tendências analíticas de forma qualitativa. A primeira refere-se à discussão de que a obrigatoriedade da pré-escola veio no bojo de outras leis que ampararam o ensino fundamental de nove anos e, por conseguinte, o encurtamento do período dedicado à educação infantil e às questões que envolvem o exercício de vivência do direito à infância das crianças.
