Trata dos diversos conceitos existentes entre criança – infância – adolescente e adolescência, além de relatar a parte histórica da criança no Brasil, onde se destacam as preocupações em separar o adolescente infrator do adulto criminoso. No segundo capítulo relata as estratégias de conter a criminalidade infantil. Já no terceiro capítulo trata das instituições brasileiras para menores infratores, destacando-se algumas instituições do Rio de Janeiro, São Paulo e Brasília como instituições para reabilitação de menores infratores. No quarto capítulo é descrita a desigualdade e a cultura entre a formação social, a cultura política e a construção da cidadania. No capítulo cinco trata-se dos adolescentes privados de liberdade no Brasil e as medidas sócio educativas. Além disso, demonstra-se através do Levantamento Nacional do Atendimento Socioeducativo ao Adolescente em Conflito com a Lei de 2009, as informações quantitativas atualizadas sobre a execução da internação provisória e das medidas sócio educativas de internação e semiliberdade existentes no país. Por fim, conclui-se que mesmo reduzindo a imputabilidade penal, o acréscimo do tempo de internação, a rigorosidade das punições não irão recuperar o menor infrator, porém um tratamento, a educação e a prevenção serão capazes de abrandar a delinquência, assim para o combate do que já existe, não será a segregação que irá recuperá-lo, muito pelo contrário, o levará para o caminho da degeneração, portanto, ser rigoroso não gerará eficácia e eficiência, mas sim o levará a revolta, o desespero culminando com a reincidência, e é exatamente isso que não se espera para os menores infratores.This work is a literature review and descriptive about the juvenile delinquents in Brazil and its criminal implications. Treats the different concepts among children - childhood - teen and teenage years, besides reporting the historical part of the child in Brazil, where we highlight the concerns of youth offenders separate the adult criminal. The second chapter describes the strategies to contain the child crime. In the third chapter deals with Brazilian institutions for young offenders, especially some institutions in Rio de Janeiro, Sao Paulo and Brasilia as institutions for the rehabilitation of juvenile offenders. The fourth chapter describes the culture of inequality and social formation, political culture and the construction of citizenship. In chapter five of these are incarcerated adolescents in Brazil and socio-educational measures. Moreover, it is demonstrated through the National Survey of Socio-Educational Services for Adolescents in Conflict with the Law of 2009, quantitative information on the implementation date of detention and socio semiliberty and educational procedures in the country.
