Uma análise acerca da violência doméstica e familiar contra a mulher e da (in)eficácia das medidas protetivas de urgência previstas na lei nº 11.340 de 2006 durante a pandemia de COVID-19

The COVID-19 pandemic has affected numerous countries. The resulting impacts affected several societies, with repercussions on health, education, industry, economy, politics and security. In the legal sphere, several discussions were held aimed at understanding the impacts caused by the COVID-19 pandemic. One of the discussions is focused on understanding the effectiveness, or ineffectiveness, of the Maria da Penha Law. Measures to combat the pandemic, such as social isolation, have brought situations of intensified vulnerability for victims of domestic and family violence. With this, the objective of this work is to understand the impacts of the COVID-19 pandemic on domestic and family violence against women as well as the urgent protective measures of the Maria da Penha Law. To this end, the deductive method was used to carry out the research, using the bibliographic and documentary research as a data collection technique, considering the use of the content of laws, official documents from government agencies and others. This research concludes with the evidence of the creation and modification of means to support victims of domestic and family violence and also significant increases in this violence during the pandemic period. Still, it is concluded that there was an oscillation regarding the granting of protective measures, in periods with greater and others with lesser concessions during the pandemic. The importance of broader public policies and actions was also highlighted, to reach women who are marginalized due to the impossibility of accessing the internet or reading.
