Classification of Moral Harm in Labor Courts: A Critical Analysis from the Point of View of Accessing Justice and the Democratic Constitutional Process

Resumo: Law 13.467/2017 and Act 808/2017 established the classification of moral harm in the labor courts and determined the criterion of the employee´s salary as the indemnity amount. Dispositions are, however, unconstitutional since they are against the basic right to equality, besides segregating people. The casuistic analysis of the extension of the harm is impaired and it is an offense towards the access of justice and to the constitutional model of the democratic process. It privileges judicial initiative to the detriment of the rights of the parties involved in the suit to construct discursively a final solution. Access to justice is a right which is concretized when the parties may participate in the construction of the process and their allegations and proofs are rationally analyzed by the judge. The theme is justified due to its modernity, practical and theoretical relevance. Through bibliographical and documental research, one may identify aporias, build critical analyses and show that the proposal to label moral harm in labor justice is an offense to material equality, access to justice and to the constitutional model of the process.

La Ley 13.467/2017 y Medida Provisional 808/2017 instituyeron la fijación del daño moral en la justicia del trabajo, estableciendo como criterio do quantum indemnizatorio el sueldo del empleado. Tales disposiciones legislativas son materialmente inconstitucionales, pues ofenden del derecho fundamental a la igualdad material, además de segregar y cosificar personas. Se impide el análisis casuístico de la extensión del daño, constituyendo ofensa al acceso a la justicia y al modelo constitucional de proceso democrático. Se privilegia el protagonismo judicial en detrimento del derecho de las partes involucradas en la lide construir discursivamente la destinación final. El acceso a la justicia es un derecho que se efectiva cuando las partes pueden participar de la construcción del mérito procesual, teniendo sus alegaciones y pruebas racionalmente analizadas por el juzgador. La elección del tema se justifica por su actualidad, relevancia práctica y teórica, pues por intermedio de las investigaciones bibliográfica y documental fue posible identificar aporías, construir análisis críticos y demonstrar que la propuesta de tarifación del daño moral en la justicia del trabajo constituye ofensa à igualdad material, acceso a la justicia y modelo constitucional del proceso.A Lei 13.467/2017 e Medida Provisória 808/2017 instituíram o tabelamento do dano moral na justiça do trabalho, estabelecendo como critério do quantum indenizatório o salário do empregado. Tais disposições legislativas são materialmente inconstitucionais, pois ofendem do direito fundamental à igualdade material, além de segregar e coisificar pessoas. Impede-se a análise casuística da extensão do dano, constituindo ofensa ao acesso à justiça e ao modelo constitucional de processo democrático. Privilegia-se o protagonismo judicial em detrimento do direito de as partes envolvidas na lide construírem discursivamente o provimento final. O acesso à justiça é um direito que se efetiva quando as partes podem participar da construção do mérito processual, tendo suas alegações e provas racionalmente analisadas pelo julgador.
